Compulsory Mediation

We believe mediation should be compulsory for both parents after separation and required before entry into the court system is allowed (unless agreed by a judge). Any parent refusing to attend may be so ordered by the court and on subsequent refusal will be charged with contempt of court.

Of course, it would be far better if couples could sort things out for themselves before resorting to courts. Requiring all couples to attend mediation would be a step to help more parents do this.

Currently, our ‘winner takes all’ family justice system, gives no incentive for the ‘winner’ to enter into mediation or any discussions at all with the other parent so many couples embark on a highly damaging (and expensive) fight when they have not even been shown there is a better way.
